DMCA Copyright Policy

Overview

Buzzaboo, Inc. ("Buzzaboo") respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), 17 U.S.C. ยง 512, we will respond expeditiously to claims of copyright infringement committed using our Service.

This policy outlines the information required to support a claim of copyright infringement and the process for submitting such a claim to Buzzaboo.

Filing a DMCA Notice of Copyright Infringement

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on our Service, you may notify our designated Copyright Agent by providing the following information in writing (see 17 U.S.C. ยง 512(c)(3) for further details):

  1. Identification of the copyrighted work: Identify the copyrighted work that you claim has been infringed. If multiple copyrighted works are covered by this notification, you may provide a representative list.
  2. Identification of the infringing material: Identify the material that you claim is infringing and that you request be removed, and provide sufficient information to permit us to locate the material. Please provide the URL(s) of the specific page(s) where the material appears.
  3. Your contact information: Provide your name, mailing address, telephone number, and email address.
  4. Statement of good faith belief: Include the following statement: "I have a good faith belief that the use of the copyrighted materials described above is not authorized by the copyright owner, its agent, or the law."
  5. Statement of accuracy: Include the following statement: "I swear, under penalty of perjury, that the information in this notification is accurate and that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed."
  6. Your signature: Provide your physical or electronic signature.

Response to DMCA Notices

Upon receipt of a valid DMCA notice, Buzzaboo will:

  • Remove or disable access to the allegedly infringing material
  • Notify the user who posted the material that it has been removed or disabled
  • For repeat infringers, terminate their accounts in appropriate circumstances

Filing a DMCA Counter-Notice

If you believe that material you posted was removed or disabled by mistake or misidentification, you may file a counter-notice with our Copyright Agent by providing the following information in writing (see 17 U.S.C. ยง 512(g)(3) for further details):

  1. Identification of the material: Identify the material that has been removed or disabled and the location where the material appeared before it was removed or disabled (provide the URL).
  2. Statement under penalty of perjury: Include the following statement: "I swear, under penalty of perjury, that I have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled."
  3. Your name, address, and telephone number: Provide your full legal name, mailing address, telephone number, and email address.
  4. Consent to jurisdiction: Include the following statement: "I consent to the jurisdiction of the Federal District Court for the judicial district in which my address is located (or the Northern District of California if my address is outside of the United States), and I will accept service of process from the person who provided the original DMCA notification or an agent of such person."
  5. Your signature: Provide your physical or electronic signature.

Send your counter-notice to our Copyright Agent at the address listed above.

Response to Counter-Notices

Upon receipt of a valid counter-notice, we will forward it to the party who submitted the original DMCA notice. If we do not receive notice within 10-14 business days that the original complainant is seeking a court order to prevent further infringement, we may restore the removed material.

Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, Buzzaboo has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of users who are deemed to be repeat infringers.

We may also, at our sole discretion, limit access to the Service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

Copyright Strikes

Buzzaboo uses a copyright strike system:

  • First Strike: Warning and removal of infringing content
  • Second Strike: Temporary suspension (7 days) and removal of monetization privileges
  • Third Strike: Permanent account termination

Copyright strikes expire after 90 days if no further infringements occur.

Fair Use

Buzzaboo respects the doctrine of fair use, which permits limited use of copyrighted material without permission for purposes such as criticism, commentary, news reporting, teaching, scholarship, or research.

However, fair use is determined on a case-by-case basis, and we encourage users to seek legal advice if they are uncertain about whether their use of copyrighted material constitutes fair use.

Important: Simply adding commentary or transformative elements does not automatically make something fair use. Factors considered include:

  • The purpose and character of the use (commercial vs. educational)
  • The nature of the copyrighted work
  • The amount and substantiality of the portion used
  • The effect of the use on the market for the original work

Music & Audio Copyright

Streamers should be particularly aware of music copyright:

  • Licensed Music: Use music from Buzzaboo's licensed music library or services like Epidemic Sound, Pretzel Rocks, or similar
  • Original Music: Music you have created and own the rights to
  • Public Domain: Music that is in the public domain (typically works published before 1928 in the US)
  • Royalty-Free Music: Music explicitly licensed as royalty-free

Warning: Playing copyrighted music (including from Spotify, Apple Music, or radio) during your stream is likely a copyright violation.

Game & Software Copyright

Most game publishers allow streaming of their games, but streamers should:

  • Check the game publisher's streaming policy
  • Respect embargo dates for unreleased games
  • Not stream pirated or illegally obtained games
  • Be aware that some games contain licensed music that may trigger copyright claims

False Claims

Under the DMCA, anyone who knowingly makes a material misrepresentation in a DMCA notice or counter-notice may be liable for damages, including costs and attorneys' fees.

Buzzaboo takes false copyright claims seriously and reserves the right to take action against users who submit fraudulent DMCA notices.
